Welcome to KD Global (“we”, “us”, “our”), an online test preparation platform dedicated to helping students prepare for standardized exams including GMAT, GRE, SAT, ACT, IELTS, TOEFL, PTE, and AP.

These Terms of Use (“Terms”) govern your access to and use of our website (kdglobal.com and any subdomains), mobile applications, digital courses, diagnostic assessments, practice materials, mock tests, and any related services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Eligibility

You must be at least 18 years old to create an account or use most features of the Services. If you are under 18, you may only use the Services under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.

  • You are responsible for maintaining the confidentiality of your account credentials.
  • Notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts for violations of these Terms.

3. License to Use the Services

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial test preparation purposes only.

4. User Content

You may submit content such as responses to diagnostics, feedback, or forum posts (“User Content”). By submitting User Content:

  • You grant us a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with providing and improving the Services.
  • You represent that your User Content does not infringe any third-party rights and is not unlawful, harmful, or abusive.

We may remove or disable access to any User Content at our sole discretion.

5. Prohibited Conduct

You agree not to:

  • Copy, reproduce, distribute, modify, create derivative works from, or publicly display any part of the Services or our materials without express written permission.
  • Use automated systems (bots, scrapers, crawlers) to access the Services.
  • Attempt to gain unauthorized access to any part of the Services, accounts, or systems.
  • Share your account credentials or allow others to use your account.
  • Use the Services for any commercial purpose or to prepare others commercially.
  • Engage in cheating, impersonation, harassment, or any activity that disrupts the learning environment.
  • Reverse-engineer, decompile, or attempt to extract source code from the Services.

6. Intellectual Property

All content on the Services—including text, videos, questions, explanations, mock tests, graphics, logos, software, and design—is owned by KD Global or our licensors and protected by copyright, trademark, and other intellectual property laws.

Fair Use & Trademark Disclaimer (University Logos) Any university logos or names displayed on our website (e.g., Stanford, Harvard, MIT, Oxford, Cambridge, etc.) are used solely for informational and educational purposes to indicate institutions that accept or consider the standardized exams we help students prepare for. We are not affiliated with, endorsed by, sponsored by, or in any way officially connected to these universities or any other institutions. Logos are used in good faith under principles of fair dealing/fair use for non-commercial, educational reference only and in compliance with applicable trademark and copyright laws in India and internationally. No permission, license, or endorsement is implied or claimed.

7. Payments and Subscriptions

  • All fees are non-refundable except as expressly stated in our Refund Policy (linked below or available upon request).
  • You are responsible for all charges incurred under your account.
  • We use third-party payment processors; your payment information is not stored by us.

8. Refund Policy

Refunds are available only within the first 7 days of purchase for most courses, provided less than 10% of the course content has been accessed. Diagnostic assessments and subscription renewals are generally non-refundable. Contact info@kdglobaledu.com for refund requests.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee:

  • That the Services will meet your specific score goals or expectations.
  • That results will be achieved.
  • Uninterrupted, error-free, or secure access.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KD GLOBAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless KD Global, its officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your use of the Services.

12. Termination

We may suspend or terminate your access to the Services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or to us.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mysuru, Karnataka, India.

For users outside India, we comply with applicable local laws to the extent required.

We may update these Terms from time to time. We will post the revised version on this page with an updated date. Continued use of the Services after changes constitutes acceptance.
